Court annulled test obligation

The obligation to get a negative Covid-19 test before returning to the Czech Republic from abroad was annulled by the court.

According to the Prague City Court, the Ministry of Health failed to sufficiently explain why this measure is necessary - as people also have to get a second Covid-19 test after returning to Czechia. The ruling will take effect on April 5.

From March 15, submitting a proof of a negative coronavirus test has been a condition for entering Czech territory from almost anywhere in the world. The court stated that it was not possible to resign from the basic principles of the rule of law and the right of Czech citizens to return to their homeland without it being absolutely necessary.

This is what the Ministry failed to document - whether its objective could not be achieved by more lenient means, in particular by restrictions imposed on a Czech citizen only after entering the territory of the Czech Republic. The Ministry is now becoming acquainted with the verdict and has not yet commented. By setting the effect on April 5, the court has given the Ministry time to re-adopt a similar measure, if necessary, and to take into account the arguments from the verdict.
